The 24 star was at an after-party for the annual event when he allegedly saw Jack McCollough, a Proenza Schouler designer, knock over Brooke Shields. That incident which occurred in New York, could affect the actor’s status all the way back in Los Angeles. Sutherland, who may have been drinking at the time of the scuffle, is still currently on probation for a 2007 DUI. (He has since served 48 days in jail for that California arrest.) If it’s determined that he violated the conditions of his release, it’s possible the 42-year-old could face time behind bars again. Production on the Season 8 of his FOX series is currently scheduled to begin later this month.

According to the New York Daily News, Kiefer plans to face NY prosecutors on Thursday morning for a possible third-degree assault charge.
